Family law is a field of law under civil law which deals with family issues. The main subjects of family law are engagement, conditions, and provisions of marriage, conditions and consequences of divorce, property regimes, family housing, paternity, adoption, custody, child’s right to alimony, guardianship, trustee, legal counselling, and support alimony. Even though women’s rights and children’s rights are a separate field of study in itself, they are also involved in family law.
Why do we have family law?
Resolving disputes concerning the family law regulated in the Turkish Civil Code comes under the jurisdiction of Family Courts. For this reason, all divorce cases must be filed in Family Courts regardless of the reason of the divorce. In case of non-existence of the family court, The Civil Court of First Instance is also responsible for proceeding divorce and separation cases. Divorce is the termination of a valid marriage upon the request of one of the spouses by a court decision based on the reasons and conditions prescribed by the law.
